The New York State Office of the Professions has mandated
that, during the registration period beginning January 1, 2008, dentists who
are required to complete continuing education must, on a one-time basis,
complete a three-hour course in New York State jurisprudence and ethics.
This course focuses primarily on case presentations of ethical dilemmas
involving common grounds for ethical complaints and disciplinary actions.
Knowledge of the rules and regulations governing the practice of dentistry is
imputed to all licensed practitioners and ignorance of the law or ethics is
never a defense.
Course
Objectives:
- Identify and analyze
the ethical dilemmas which commonly occur in the operation of a dental
practice.
- Determine alternative
conduct applying the ADA Principles of Ethics and Code of Professional
Conduct and NYSDA Code of Ethics.
- Know and comply with
applicable laws, rules and regulations.
- Maintain an
interactive values-based discussion with other professionals and the
community.

Chester J. Gary, DDS '78, JD '91 is clinical assistant professor
in the Department of Restorative Dentistry and course director of Practice and
Risk Management, University at Buffalo School of Dental Medicine. He is a practicing general dentist, licensed
in New York, and an attorney-at-law, admitted in New York and Florida. His law practice is concentrated on
issues relevant to health care providers and represents dentist employees and
employers in Employment Agreements, partners in Partnership Agreements and
entity formation, buyers and sellers in practice sales and dentists personally
in malpractice litigation. Dr.
Gary serves as a member of the New York State Dental Association (NYSDA)
Attorney Panel and author and certified presenter of the New York State
mandated Dental Jurisprudence and Ethics Course. He serves as chair of the NYSDA District Professional
Liability Claims Committee, editor of the Eighth District Dental Society
Bulletin, reviewing editor of the New York State Dental Journal and Journal of
the American Dental Association, president of the University at Buffalo School
of Dental Medicine Alumni Association, is a fellow of the American College of
Dentists and American College of Legal Medicine, and a member of the New York
and Florida Bar Associations. Dr. Gary has published numerous articles and lectured
extensively regarding dentistry, ethics and the law.

a commercial company with which he has a significant relationship. |
